Terms of Service
Effective date: July 19, 2026
These Terms of Service (the "Terms") govern your use of neighborsavermail.com (the "Site") and every direct mail order you place with Neighbor Saver, LLC, doing business as NeighborSaver ("NeighborSaver"), a family-run business operated by Rick and Marci Herman, 1315 Granada Blvd, Coral Gables, FL 33134.
By submitting an order form, requesting a quote, or paying for an order, you agree to these Terms and acknowledge our Privacy Policy. If you are agreeing on behalf of a business, you confirm you have authority to bind that business. You must be at least 18 years old to place an order. The version of these Terms in effect on the date you place an order governs that order.
1. What we do
NeighborSaver helps advertisers plan, print, and mail direct mail — postcards, menus, flyers, and oversized mailers — anywhere in the United States. You can reach your audience three ways:
- EDDM / area-based mailings, which reach every address on selected postal carrier routes (no mailing list needed);
- Your own mailing list, which you upload; or
- A targeted list we source for you from third-party list providers.
We also offer optional, paid artwork creation.
2. How orders work: quotes, acceptance, and payment
Every order today is reviewed and priced by us, personally — a real person, not an automated system. Here is the sequence, and it matters legally:
- You submit the order form with your mailpiece, audience, and quantity details. Submitting the form is a request for a quote, not a completed purchase, and you are not charged at submission.
- We review the details — audience, artwork, quantity, and compliance — and contact you with your confirmed price and payment instructions.
- A binding order is formed when we confirm your price and you pay it. Nothing is ever charged automatically, and we have no subscriptions or recurring charges.
The print and production portion of the price we confirm with you stays open for 30 days from the date of your quote; if you pay after that window lapses, we may need to re-quote. Postage is set by USPS and is always subject to change — it is passed through at the rate in effect when your order is charged, which may differ from the rate at the time of your quote.
Quoted quantities for EDDM and area-based mailings are approximate: actual counts follow USPS carrier-route boundaries, and we will select routes to fit within the quantity you purchased and will not exceed it without your approval.
If we later add self-serve online checkout (planned, via Stripe), we will update these Terms before it launches; until then, all payment is arranged directly with us.
3. Artwork, proofs, and your content
- You may upload finished artwork or purchase our design services.
- You are responsible for the accuracy and legality of your content — offers, prices, phone numbers, addresses, coupons, and any claims your mailpiece makes.
- You represent and warrant that you own or have the rights to all text, images, logos, and other material you provide, and that your mailpiece does not infringe anyone's intellectual property, publicity, or privacy rights and complies with the laws that apply to your business and your offer.
- Where we provide a proof, production does not begin until you approve it. Approving a proof means you accept the piece as shown, including spelling, layout, colors as represented on screen, offers, and contact details. We are not responsible for errors that appear in an approved proof.
- All mailpieces must meet USPS mailability and format standards. We may require changes, or decline a piece, if it cannot lawfully or physically be mailed.
4. Mailing lists
Lists you provide. If you upload your own mailing list, you represent and warrant that you have the legal right to use it for the mailing you are ordering, that it was collected lawfully, and that mailing to it complies with the laws that apply to you and your industry. We use your list only to prepare and send your campaign; we never sell, rent, or reuse it for our own purposes. We may clean, validate, or standardize the file before mailing, and we may decline any list that we believe cannot be lawfully or reliably mailed.
Restricted audiences. Campaigns targeting military personnel, medical or patient populations, financially sensitive categories, or minors are never processed on an automated basis — a human reviews every such request before anything is quoted, and we may require documentation or decline the campaign.
Lists we source. Targeted lists we purchase for your campaign are licensed for that campaign. Third-party list costs are non-refundable once incurred (see Section 6).
5. What we don't guarantee
Final delivery is performed by the U.S. Postal Service. Delivery timing depends on USPS, and we do not guarantee delivery dates or in-home dates. We also do not guarantee any particular response rate, sales result, or business outcome from any mailing — no one honestly can. Postage is set by USPS, is always subject to change, and is passed through at the rate in effect when your order is charged.
6. Cancellations and refunds
Where you are in the process determines what is refundable:
- Before payment. If you change your mind before we confirm your price and collect payment, nothing is owed — just tell us.
- After payment, before production. If you cancel after paying but before we submit your print-ready file to the print vendor, we will refund your payment, minus any list or data costs we have already incurred on your behalf (purchased lists are licensed per campaign and are non-refundable to us). Production begins when the print-ready file is submitted to the vendor.
- After production begins. Once printing, list purchase, or mail preparation has started, the portion of your payment covering that work is non-refundable, because those costs have been spent on your job. Any portion covering work not yet started will be refunded.
- After mailing. Completed mailings are non-refundable.
- Paid artwork. The artwork creation fee is non-refundable once design work begins.
To cancel, call 610-331-7060 or email info@neighborsavermail.com; a cancellation is effective when we receive it. Refunds are issued to the original payment method within a reasonable time, not to exceed 30 days.
7. If we make an error
If we make a mistake — for example, printing artwork different from your approved proof, or mailing to an area other than the one you purchased — your exclusive remedy is, at our option, a reprint and re-mail of the affected pieces or a refund of the amount you paid for the affected portion of the order. To claim, notify us within 10 days after we confirm to you that your mailing has entered the mail stream, with enough detail for us to verify the error. This remedy does not apply to errors contained in a proof you approved or to USPS delivery performance.
8. Acceptable use
You will not use the Site or our services to send unlawful, deceptive, harassing, defamatory, or infringing material, or to mail to lists you are not authorized to use. We may decline, suspend, or cancel any order that we reasonably believe violates these Terms, USPS standards, or applicable law; if we cancel for this reason before production, we will refund amounts paid less costs already incurred.
9. Intellectual property
You keep ownership of the artwork and content you provide; you grant us a limited license to use it solely to produce and mail your order. For paid artwork we create, ownership of the final approved design transfers to you upon payment in full; until then we retain ownership. We will not use your artwork, content, or lists for any other purpose without your permission. The Site and our own materials remain ours.
10. Disclaimer of warranties
Except as expressly stated in these Terms, our services are provided without warranties of any kind, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Commercial printing involves normal variation: minor differences in color, cropping, and paper stock between a screen proof and the printed piece are not defects.
11. Limitation of liability
To the fullest extent permitted by law: (a) NeighborSaver's total liability for all claims arising out of or relating to an order or these Terms will not exceed the amount you paid for that order; and (b) NeighborSaver will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost business opportunity, even if advised of the possibility. These limits apply to claims in contract, tort (including negligence), or otherwise, and they reflect the agreed allocation of risk in our pricing. They do not limit liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.
12. Your indemnification
You will defend and indemnify NeighborSaver and its owners against third-party claims, losses, and reasonable attorneys' fees arising from (a) the content of your mailpiece, (b) a mailing list you provided, including claims that it was unlawfully collected or used, or (c) your violation of law or of these Terms. We will promptly notify you of any such claim and reasonably cooperate at your expense. We may participate in the defense with our own counsel at our own cost, and you may not settle any claim in a way that imposes obligations on us or admits fault on our behalf without our written consent.
13. Events beyond our control
We are not responsible for delay or failure caused by events beyond our reasonable control, including USPS service disruptions, carrier delays, paper or material shortages, utility or internet outages, labor disputes, weather, or government action. If such an event stops us from completing your order, we will work with you to reschedule or refund the unperformed portion.
14. Governing law and venue
These Terms and every order are governed by Florida law, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally must be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and both parties consent to personal jurisdiction and venue there. Before filing, we ask (but do not require) that you contact us first — most problems can be fixed with a phone call.
15. Changes to these Terms
We may update these Terms from time to time. The effective date above shows the current version, and updates apply to orders placed after they are posted. The version in effect when you place an order governs that order — a later change never rewrites a deal you already made.
16. General
If any provision of these Terms is held unenforceable, the rest remain in effect, and the provision will be enforced to the maximum extent permitted. These Terms and your confirmed order details (quote, quantity, artwork, mailing area, price) are the entire agreement for your order; if a confirmed order document conflicts with these Terms, the confirmed order controls — but only as to price, quantity, specifications, and schedule, not the refund, remedy, liability, or indemnification provisions of these Terms. You may not assign your order without our consent; we may use qualified vendors (printers, list providers, mail houses) to perform. Our not enforcing a provision is not a waiver of it. Sections 9 (Intellectual property), 10 (Disclaimer), 11 (Limitation of liability), 12 (Indemnification), and 14 (Governing law and venue) survive completion or cancellation of your order.
